S T A T U T S

 

DENOMINATION AND POLITICS

 

The name of the association is Mexican Society of Criminology of the State of Nuevo Leon (Sociedad Mexicana de Criminología Capítulo Nuevo León), hereafter referred to as Non Government Organization (ONG).

 

The association will take a politic established in these statutes.

 

The adress is in the city of San Nicolás de los Garza, Nuevo León, Mexico.

 

GOALS

 

It is a non goverment organization, without politic affairs either religious, who represents to any criminologist and professional of the forensic sciences. His goals are developing and encourage the criminological knowledge.

 

AIMS

 

The aims of the society are:

 

I. Develop criminological researches;

II. Courses, conferences and Congresses;

III. To create mediums for the publishing of, among other things, research results;

IV. To cooperate with interested local, regional and international institutions;

V. To inform the community and Government about crime-related phenomena, criminal and reaction to crime;

VI. Job opportunities;

VII. Execute any act and contract necessary to get its goals.

 

THE MEMBERS

 

Conduct

 

I. Criminologists have a responsibility to devote their professional knowledge and skills in a scientific manner for the benefit of each individual, group, community and mankind with due consideration of their personal and professional limitations;

II. In situations in which criminologists are requested to render a professional judgment, they should honestly, accurately and fairly represent their areas and degrees of expertise.

III. In their roles as practitioners, researchers, educators and administrators, criminologists have an important social responsibility because their recommendations, decisions and actions may alter the lives of others. They should be aware of the situations and pressures that might lead to the misuse of their influence and authority.

IV. In fulfilling these various roles, criminologists should also recognize that professional problems and conflicts might interfere with professional effectiveness. Criminologists should take steps to ensure that these conflicts do not produce deleterious results for members of society, research participants, colleagues, learners and employees. The criminologist should therefore avoid performing multiple and conflicting roles, for example, being a witness and a consultant for a legal defense team only. It is crucial that criminologists should clarify their role as expert from the outset.

 

The Society consists of:

 

1) Professional members;

2) Student (Honorary) members;

3) Group members; and

4) Honor members.

 

Membership shall be available to those persons who are: 1) professionally engaged in Criminology related fields; 2) studying in Criminology related disciplines in colleges or universities; or 3) have a professional interest in criminology-related study or practice.

 

All applications for regular membership must be approved by the President, Vicepresident and Treasury.

 

Professional members are:

 

The people who have at least a bachelor degree in a criminological science or another related post-graduate qualification which is recognized by the Society.

 

Student members:

 

Any student enrolled in a criminological science or another related discipline accepted by the Council may join the Society as a student member. A student member may participate in the activities of the Society.

 

Group members:

 

Institutional membership shall be available to those public or private organizations with a major function that is both directly related to the field of criminology and supports the goals of the Society. All applications for institutional membership must be approved by the Executive Board.

Honor members:

 

Honor membership is at the invitation of the Board and is bestowed by the Board in recognition of a particular contribution in the field of criminological sciences or to the Society. An honor member has the same privileges as active individual members of the Society.

 

MEMBERSHIP FEES

 

Membership fees of the Society will be determined by the Executive of Council from time to time, provided that different membership fees may be determined for each category of membership.

 

Honor members of the Society pay no membership fees.

 

RIGHTS OF THE MEMBERS

 

I. Get information about Criminology and Forensics sciences come from around the world. Dialogue with professionals of many criminological sciences;

II. Information about national and international events;

III. Publish thru the web site (depends of the language) researching results;

IV. Capacitating done by the society; and

V. Job opportunities.

 

THE COUNCIL

 

The Council consists of at least of:

ELECTION OF THE COUNCIL

 

The election is done every two years by the vote of everyone.

 

POWERS OF THE COUNCIL

 

I. Subject to any decisions taken at a general meeting of the Society, the Council delegates its powers to the Executive of Council who will meet regularly to control, manage and administer all the affairs of the Society and is, without prejudicing the generality of this provision, further vested with the following specific powers:

 

1. Admission to and termination of membership;

2. Determining membership fees;

3. Instituting committees and determining the assignments of those committees;

4. Collecting and allocation of money;

5. Delegating any or all its powers to a person or committee, provided that the Council retains the power at all times to also exercise that power;

7. Giving a ruling on representations made by or on behalf of a member or a committee; and

8. Rawing up a programme of the activities of the Society.

 

TERMINATION OF MEMBERSHIP

 

Membership is terminated by a member resigning in writing to the Council or when abandoned his position for more than 3 months without causes.

 

OFFICERS

 

The President:

 

Shall be the Chief Executive of the Society, shall represent it at formal gatherings, and shall preside over the meetings of the Executive Board and over the Annual Meetings. Shall appoint replacements for any of the above positions that are vacated.

 

The Vicepresident:

 

Shall preside over the meetings of the Society in the absence of the President

 

Secretaries:

 

Shall take note of the reunions and contact people in order to make relations.

 

Treasurer:

 

Shall take care of the financial situation of the Society.

 

Newsletter and Journal Editor and Assistance:

 

Shall oversee the publication of the Criminological Bulletin and of the “Criminology, Forensics Sciences and Private Security Files” at regular intervals.

 

Coordinators, Particular secretaries and Councelers:

 

Must take care and encourage any activity of his Commission for the research development.

 

THE JOURNAL

 

The journal is titled “Criminology, Forensics Sciences and Private Security Files” is a biannual publication; the publications are done by the web site and other mediums.

 

THE CRIMINOLOGICAL BULLETIN

 

The bulletin is titled “Criminological bulletin” is a monthly publication with information about national and international events, other associations around the world and with jobs opportunities. Is totally free for general public.

 

THE WEB SITE

 

The web site is done in order to promote events, congresses, seminars, activities, associations, the members, and the situation of the criminological science around the world. The first web site is www.somecrimnl.es.tl in the native language of the association, but due to the expansion, was necessary create the English version www.somecrimnlen.es.tl and the French version www.somecrimnlfr.es.tl.

 

FINANCES

 

I. The Society can receive money from the Government, the memberships fees, activities or any kind of job that has offered; 

II. All money received by the Society must be deposited in an account at an acknowledged financial institution appointed by the Council;

III. All expenses must be authorized by the Council and payments must be signed by the President or the Vicepresident;

IV. The Council must keep a complete record of all receipts and expenditures of the Society;

V. The financial statement of the Society must be submitted to the annual general meeting for approval after they have been certified by the Treasurer.

 

TRANSPARENCY

 

The members can use money from the account only for related things of the Society, nobody has a salary. The web site publishes the membership’s fees and in the link: Transparency.

 

DISSOLVEMENT OF THE SOCIETY

 

I. On receipt of a proposal that the Society be dissolved, the Council organizes a special meeting of the Society, giving all members at least one month’s notice in writing;

II. At such a special meeting a decision to dissolve the Society will only be valid if a two-thirds majority of the full members present vote in favour of the proposal;

III. If any assets of whatever nature remain after the liquidation of the Society such assets will be donated to an institution with the same or similar aims as the Society after payment of all debts.

ALBINO ESTRADA OLIVARES, con fundamento en lo dispuesto por el artículo 39 fracción I inciso a) del Reglamento Interior de la Secretaría de Relaciones Exteriores en vigor, se concede el permiso para constituir una AC bajo la siguiente denominación: SOCIEDAD MEXICANA DE CRIMINOLOGIA CAPITULO NUEVO LEON.- Este Permiso, quedará condicionado a que en los estatutos de la sociedad que se constituya, se inserte la cláusula de exclusión de extranjeros o el convenio previsto en la fracción I del Artículo 27 Constitucional, de conformidad con lo que establecen los artículos 15 de la Ley de Inversión Extranjera y 14 del Reglamento de la Ley de Inversión Extranjera y del Registro Nacional de Inversiones Extranjeras. Cabe señalar que el presente permiso se otorga sin perjuicio de los dispuesto por el artículo 91 de la Ley de la Propiedad Industrial. Este permiso quedará sin efectos si dentro de los noventa días hábiles siguientes a la fecha de otorgamiento del mismo, los interesados no acuden a otorgar ante fedatario público el instrumento correspondiente a la Constitución de la sociedad de que se trata, de conformidad con lo que establecido el artículo 17 del Reglamento de la Ley de Inversión Extranjera y del Registro Nacional de Inversiones Extranjeras.
